1.1 The following General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between Narimpex GmbH (hereinafter "Narimpex") and all persons, natural and legal, who use the Internet offer of Narimpex (hereinafter "Buyer"). 2.2 By clicking on the order button, the buyer places a binding order for the goods contained in the shopping basket. Before the final dispatch the buyer has the possibility on an overview side to examine the correctness of his inputs and to correct if necessary.
2.3 The offer in the webshop is subject to the condition that the goods are in stock. A contract with the buyer is concluded when Narimpex accepts the customer's order. The written copy of the order, which the customer receives by e-mail after receipt of the order, is only a confirmation of receipt, but not an acceptance of the order by Narimpex. Acceptance of Narimpex is effected by delivery of the goods. The customer agrees that the order will only be accepted by Narimpex for those goods which are in stock (goods which are not in stock will also not be delivered later).
3. price-relevant external influences
3.1 If Narimpex has to incur more expenses for the goods to be delivered than it was aware of at the time the contract was concluded through no fault of its own, these additional costs shall be borne in full by the purchaser. These are, for example, official and official measures (such as changes in customs tariffs, taxes, levies and fees, etc.).
3.2 The prices displayed in the webshop at the time of the order are binding. All prices in the webshop are in Euro, including VAT, excluding packaging and shipping costs.
4. delivery and dispatch
4.1 Delivery shall be made by sending the goods to the address provided by the Buyer. The billing address and the delivery address may be different.
4.2 As a rule, the goods are dispatched within 5 to 7 working days of receipt of the order confirmation by the buyer. Delivery periods and dates are only binding if they have been expressly confirmed as such in writing by Narimpex. For the gift sets, depending on the order quantity, special delivery periods apply: 1-9 gift sets: 5-7 days; 10-50 pieces: 2-7 working days; From 51 pieces: approx. 5-10 working days / the delivery date will be confirmed in writing.
4.3 Should it happen that a product is currently not available, the buyer will be notified by e-mail.
4.4 Deliveries will be made by a carrier of Narimpex's choice. The costs for packaging and transport insurance are included in the shipping costs, which are to be paid simultaneously with the payment of the goods in the order process.
4.5 For deliveries outside the EU, additional duties, taxes and fees are payable.
4.6 For technical reasons, an order may have to be divided into several packages. The delivered goods must be inspected for damage by the buyer immediately after receipt.
4.7 In the event of delivery being impaired by force majeure, such as natural disasters, official measures, delayed or defective deliveries, war, riots, industrial disputes, considerable operational disruptions, epidemics or similar, the delivery and service deadlines shall be extended by a reasonable amount.
4.8 If the impediment to performance lasts longer than three months, both parties may withdraw from the purchase contract.
4.9 Information on the delivery period is non-binding. Narimpex accepts no responsibility for any delay in delivery.

5.1 Unless a special place of performance has been agreed by the parties or is the result of the nature of the business, delivery shall be deemed to have taken place when the products are made available at the Seller's registered office.
5.2 Unless expressly agreed otherwise, benefit and risk shall pass from the seller to the buyer upon dispatch of the goods.
5.3 If the goods cannot be delivered to the customer at the specified delivery address, the customer shall also owe Narimpex a handling fee of Euro 40.00 (per order) for the activities caused by non-delivery.
6. prices, terms of payment
6.1 The prices in the order confirmation plus value-added tax are decisive. All prices include packaging and freight charges to the place of performance, if agreed.
6.2 Invoices and retentions of the purchaser are only permitted if they have been accepted in writing by Narimpex.
6.3 If a buyer is in arrears with several invoices, the due debt shall be repaid first and the older debt among several due debts shall be repaid. If the purchaser is in arrears with at least one payment for a delivery, Narimpex is entitled to withhold further deliveries until the outstanding invoices have been paid in full.
6.4 Payment by invoice and financing: In cooperation with Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you invoice purchase and instalment purchase as payment options. Please note that purchase on account and hire purchase are only available to consumers and payment must be made to Klarna.
Invoice: When buying on account with Klarna you always get the goods first and you always have a payment period of 14 days. The onlineshop charges a fee of 2,17 Euro per order when buying on account with Klarna.
Installment purchase: With Klarna's financing service you can pay your purchase flexibly in monthly installments of at least 1/24 of the total amount (but at least 6.95 €) or under the conditions otherwise stated in the cash register. Installment purchase is only offered for Germany.
Klarna's data protection notice: Klarna checks and evaluates your data and, if there is a legitimate interest and reason, maintains an exchange of data with other companies and credit agencies. Your personal details will be treated in accordance with the applicable data protection regulations and in accordance with the details in Klarnas data protection regulations for Germany/Austria.
6.5 Payment of the order value in the webshop is always made by credit card or PayPal or prepayment with the completion of the order in advance. In the case of company orders in the webshop, it can be inquired whether delivery can be made against invoice. Please contact us for this purpose.
6.6 The prices as well as the forwarding expenses charged to the buyer can change from time to time. Special actions and individual agreements are reserved.
7. Warranty
7.1 The customer shall inspect the goods immediately upon receipt.
7.2 If the goods are defective upon receipt, the purchaser has the choice of whether the subsequent performance is to take the form of a replacement delivery or a price refund. In any case, the purchaser must return the defective goods to Narimpex.
7.3 Excluded from any warranty are typographical errors entered by the purchaser, qualitatively inadequate images (e.g. due to insufficient resolution of digital images), self-inflicted design errors as well as incorrect product selection, incorrect order quantities or other defects caused by errors in order entry.
7.4 The customer must give written notice of defects subject to warranty within three working days of receipt of the goods, after expiry of this period no further defects can be asserted.
7.5 In the event of a warranty claim, Narimpex will either replace the defective goods or issue a corresponding credit note, at your option, provided the customer has returned the defective products. Further warranty claims of the customer are expressly excluded.
8. right of return and revocation
8.1 Duty to audit
Customers must immediately inspect the delivered or collected goods for correctness, completeness and delivery damage. Delivery damage, product defects, incorrect and incomplete deliveries must be reported within 5 working days and stored in the original packaging until Narimpex contacts the customer.
8.2 Return & revocation
Narimpex grants the right to return the ordered products within a maximum of 14 calendar days of receipt. The date of the postmark or personal return is decisive. Once this period has expired, a return is no longer possible. The right of return & revocation is excluded for goods that are

8.3 Return costs
The postage costs for the return of unwanted items shall be borne by the sender. There are the following exceptions:

If one or more of these points applies, the postage costs for the return shipment shall be borne in full by Narimpex GmbH. The purchase price can only be refunded after receipt of the return shipment.
8.4 Returns
The products must be sent to the following address: Narimpex GmbH, Turmstrasse 11, D-78467 Konstanz, Germany. Returns that cannot be assigned to any customer will be kept for two months and then disposed of and the dossier closed. After this period, claims for refunds or replacements will be void.
9 Exclusion of liability
9.1 Narimpex shall only be liable for damage resulting from the breach of a contractual obligation incumbent upon it or if it has caused such damage by gross negligence or intent.
9.2 The maximum amount of damages to be paid is limited to the agreed purchase price of the delivery concerned.
9.3 Narimpex is not liable for pure financial losses or consequential and/or reflex damages.
10. data protection Narimpex
Narimpex processes the personal data of the purchaser for a specific purpose and in accordance with the legal provisions. The personal data provided for the purpose of ordering goods will be used by Narimpex to fulfil and process the contract. These data will be treated confidentially by Narimpex and will not be passed on to third parties who are not involved in the ordering, delivery or payment process. The buyer has the right to obtain, upon request and free of charge, information about the personal data stored by Narimpex about him. In addition, he has the right to correct incorrect data, block and delete his personal data, unless there is no legal obligation to retain.
The agreement with these general terms and conditions includes the agreement for the treatment of the personal data of the buyer.

11. changes / additions
11.1 Narimpex expressly reserves the right to adapt these General Terms and Conditions to the circumstances at any time and to apply them immediately.
11.2 The customer must therefore inform himself about the respective valid General Terms and Conditions for each order.
12 Severability clause
12.1 If a clause should be ineffective, the remaining provisions shall remain effective.
12.2 The invalid clause shall be replaced by the statutory provisions.
13 Applicable law, place of jurisdiction
13.1 All disputes arising from this legal relationship are subject to German law.
13.2 The place of jurisdiction for any disputes arising from or in connection with these General Terms and Conditions and the associated contract shall be the registered office of Narimpex in Constance. Narimpex reserves the right to sue at the customer's place of business.
